Acceptance of Terms & Conditions
By enrolling your child in swimming lessons at York Swimming Academy you accept and understand the terms and conditions. The terms and conditions act as a legally binding contract between you and York Swimming Academy. The main purpose of the terms and conditions is to protect you and York Swimming Academy, and to allow York Swimming Academy to operate effectively.
Swimming lessons follow a calendar that is released annually. The lesson calendar and further details can be found on our website www.yorkswimmingacademy.com.
Lessons can be booked in the following blocks:
- 7 lessons
- 14 lessons
- 21 lessons
- 42 lessons
- 1 lesson at a time (one to one only)
Details of your child’s first class are to be agreed before payment is made. Days and times of your child’s lessons may be required to change as your child develops and progresses through our academy.
York Swimming Academy are unable to offer any sibling discounts.
Any cancellations and refunds are subject to our Cancellation and Refund policy.
Refunds and Cancellation
The right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to York Swimming Academy.
York Swimming Academy is under no obligation to refund any lessons are not attended.
All refunds due to extenuating circumstances are subject to the discretion of York Swimming Academy.
In the event that a lesson is cancelled due to severely adverse weather or acts of God, York Swimming Academy will not be liable for providing a refund.
In the event that a lesson is cancelled due to any other reason, York Swimming Academy will offer a compensatory lesson. If this is not possible, a refund will be offered.
York Swimming Academy accept payment via cash, cheque, BACS, or Card (online only).
Payment of lessons is to be made up front in full.
Prices are disclosed and confirmed before payment is to be made.
Changing Class Times and Venues
York Swimming Academy is under no obligation to change your class time and venue once it has been agreed.
Any changes are subject to the discretion of York Swimming Academy.
Video & Photography
In the interests of safeguarding children, video and photography is strictly prohibited.
York Swimming Academy will occasionally provide opportunity for photographs to be taken in a controlled manner strictly subject to consent of parents/ guardians.
York Swimming Academy cannot be held liable for the actions of third parties and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed “Video and Photography” by any party.
Personal Property, Injury, Illness and Death
York Swimming Academy will not be liable for any loss or damage you may suffer where the same is attributable to:
1. Your own fault
2. A third party unconnected with our provision of services under this agreement; or
3. Events which neither we nor our suppliers could have reasonably foreseen or forestalled even if we had taken all reasonable care.
Nothing in these terms and conditions is intended to limit or exclude our liability for death or personal injury caused by our negligence or for fraud, fraudulent misrepresentation or any other liability which cannot be excluded by law.
It is your responsibility to provide information of any existing medical conditions and to inform York Swimming Academy of any changes to medical conditions.
All information will be kept strictly confidential.
Withdrawal of Service
York Swimming Academy reserves the right to refuse entry to a client to its courses if it is felt that the client’s behaviour or the behaviour of those associated with the client is unreasonable.
Changes of Terms and Conditions
The terms and conditions may be subject to updates and minor changes.
York Swimming Academy will inform you when terms and conditions change.
Any non-acceptance to such changes should be issued in writing or email to York Swimming Academy within 14 days of the changes. Failure to do so will result in the agreement between you and York Swimming Academy being subject to the updated terms and conditions.
