1. Acceptance of Terms & Conditions

1.1. By enrolling your child in swimming lessons at York Swimming Academy you accept and understand the terms and conditions. The terms and conditions act as a legally binding contract between you and York Swimming Academy. The main purpose of the terms and conditions is to protect you and York Swimming Academy, and to allow York Swimming Academy to operate effectively.

2. Booking

2.1. Swimming lessons run continuously throughout the year and follow a calendar that is released annually. The lesson calendar and further details can be found on our website www.yorkswimmingacademy.com.

2.2. Details of your child’s first class are to be agreed before payment is made.

2.3. Days and times of your child’s lessons may be required to change as your child develops and progresses through our academy.

2.4. York Swimming Academy are unable to offer any sibling discounts.

2.5. Any cancellations and refunds are subject to our Cancellation and Refund policy.

3. Payment Policy

3.1. All fees for swimming lessons must be paid in advance of the lessons

3.2. Upon joining York Swimming Academy, you are required to pay for 2 months in advance.

3.3. Fees for lessons are taken every month, one month in advance, on the first of the month. Fees will be charged to the on-file card you have entered into the Parent Portal and will cover all lessons in the month ahead. For example, if there are four lessons in the month, you will be charged four lessons. If there are five lessons in the month, you will be charged for five lessons. We will notify you seven days before, via email, stating the amount you will be charged and which lesson dates it covers.

3.4. All fees are non-refundable unless otherwise stated in our Terms & Conditions.

3.5. Your card details are securely stored by our card processor to be used for future payments. Please contact us if you would like to delete your card details.

3.6. All communication will be with the person making the booking who accepts the terms and conditions on behalf of each swimmer.

3.7. Payments can be monitored and paid through your Parent Portal.

3.8. York Swimming Academy reserve the right to change the price of swimming lessons at any time. Customers will be notified in writing with at least 14 calendar days’ notice of any change.

3.9. For unpaid lessons, York Swimming Academy reserves the right to remove swimmers from our programme.

4. Changing Class Times and Venues

4.1. York Swimming Academy is under no obligation to change your class time and venue once it has been agreed.

4.2. Any changes are subject to the discretion of York Swimming Academy.

5. Refunds and Cancellation

5.1. The right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to York Swimming Academy.

5.2. If you want to cancel your child’s swimming lessons, you can do this via email, giving at least 4 weeks notice. Upon cancellation, any paid credit will be applied to your account, and a final lesson date will be sent to you via email. Please note that if you intend to cancel, you are requested to do this before the next month’s payment is taken from your account.

5.3. York Swimming Academy is under no obligation to refund any lessons that are not attended.

5.4. All refunds due to extenuating circumstances are subject to the discretion of York Swimming Academy.

5.5. In the event that a lesson is cancelled due to severely adverse weather or acts of God, York Swimming Academy will not be liable for providing a refund.

5.6. In the event that a lesson is cancelled due to any other reason, York Swimming Academy will offer a compensatory lesson. If this is not possible, a refund will be offered.

6. Video & Photography

6.1. In the interests of safeguarding children, video and photography is strictly prohibited.

6.2. Mobile devices with photo/video capability must not be used when in changing room areas.

6.3. York Swimming Academy will occasionally provide opportunity for photographs to be taken in a controlled manner strictly subject to consent of parents/ guardians.

6.4. York Swimming Academy cannot be held liable for the actions of third parties and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed “Video and Photography” by any party.

7. Personal Property, Injury, Illness and Death

7.1. York Swimming Academy will not be liable for any loss or damage you may suffer where the same is attributable to:

• Your own fault
• A third party unconnected with our provision of services under this agreement; or
• Events which neither we nor our suppliers could have reasonably foreseen or forestalled even if we had taken all reasonable care.

7.2. Nothing in these terms and conditions is intended to limit or exclude our liability for death or personal injury caused by our negligence or for fraud, fraudulent misrepresentation or any other liability which cannot be excluded by law.

8. Medical Conditions

8.1. It is your responsibility to provide information of any existing medical conditions and to inform York Swimming Academy of any changes to medical conditions.

8.2. All information relating to the above will be kept strictly confidential.

9. Withdrawal of Service

9.1. York Swimming Academy reserves the right to refuse entry to a client if it is felt that the client’s behaviour or the behaviour of those associated with the client is unreasonable or inappropriate.

10. Changes of Terms and Conditions

10.1. The terms and conditions may be subject to updates and minor changes.

10.2. York Swimming Academy will inform you when terms and conditions change.

10.3. Any non-acceptance to such changes should be issued in writing or email to York Swimming Academy within 14 calendar days of the changes. Failure to do so will result in the agreement between you and York Swimming Academy being subject to the updated terms and conditions.
